COPYRIGHT / DMCA POLICY

Show Streamz, Inc. (“Show Streamz,” “we,” “us”) respects the intellectual property rights of others and expects Users (including Fans, Talent, Venues, Promoters, and Production Vendors) to do the same. This Copyright / DMCA Policy (“Policy”) explains how to submit copyright infringement notices and counter-notices under the Digital Millennium Copyright Act (“DMCA”) and how Show Streamz responds to claims of infringement on the Show Streamz Platform (the “Platform”).

This Policy is incorporated into the Show Streamz Terms & Conditions. Capitalized terms not defined here have the meanings in the Terms.

1. Scope and What This Policy Covers

This Policy applies to claims that Content available on the Platform infringes a copyright. This includes:

  • live streamed Events and recordings (VOD);

  • clips, highlights, thumbnails, artwork, and metadata;

  • user posts/comments (where enabled);

  • profile images and bios.

This Policy does not govern disputes about:

  • ownership splits, royalty accounting, or contract disagreements between rights holders and Event Providers (those are private disputes);

  • alleged defamation, harassment, or privacy violations (use the Community Guidelines/reporting);

  • trademark complaints (see Section 10).

However, you may still notify us at legal@showstreamz.com and we will route appropriately.

2. Designated DMCA Agent

If you believe Content on the Platform infringes your copyright, submit a DMCA notice to our Designated Agent:

3. How to Submit a DMCA Takedown Notice (Copyright Owner or Authorized Agent)

To be effective under the DMCA, a notice must be a written communication that includes all of the following:

  1. Identification of the copyrighted work claimed to have been infringed

    • Provide the title, author/creator, and (if available) a registration number or a link to an official source.

    • If multiple works are involved, provide a representative list.

  2. Identification of the allegedly infringing material and where it is located

    • Provide sufficient information for us to locate it, such as:

      • Event name and date/time;

      • the specific URL(s) on the Platform;

      • clips/VOD links;

      • timestamps (highly recommended);

      • screenshots (if available).

  3. Your contact information

    • Full legal name, company (if applicable), mailing address, phone number, and email address.

  4. A statement of good faith belief

    • “I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”

  5. A statement under penalty of perjury

    • “The information in this notice is accurate, and under penalty of perjury, I am the owner (or authorized to act on behalf of the owner) of an exclusive right that is allegedly infringed.”

  6. A physical or electronic signature

    • Typed full name is generally acceptable as an electronic signature.

Important Notes
  • Submitting knowingly false claims may result in liability under applicable law.

  • If your claim involves a license dispute, unclear ownership, or competing claims, we may request additional information before acting.

4. What Happens After We Receive a Valid Notice

Upon receiving a complete and valid DMCA notice, Show Streamz may take actions that can include:

  • disabling access to the identified material (removal/takedown);

  • restricting playback of an Event/VOD;

  • disabling clips or related promotional assets;

  • placing appropriate account flags;

  • notifying the User/Event Provider who posted or streamed the material (the “Alleged Infringer”).

We may also:

  • request additional detail (especially for live events or time-sensitive claims);

  • implement temporary restrictions while evaluating;

  • preserve evidence for legal compliance.

For urgent live-event issues, include “URGENT — LIVE EVENT” in the subject line and provide timestamps and Event links whenever possible.

5. Counter-Notice Process (If You Believe a Takedown Was a Mistake)

If your Content was removed/disabled due to a DMCA notice and you believe removal was erroneous (e.g., misidentification, license, fair use), you may submit a counter-notice to legal@showstreamz.com.

A valid counter-notice must include:

  1. Identification of the removed material and its prior location

    • Provide the Event/VOD/clip title and the URL(s) where it appeared, plus timestamps if applicable.

  2. A statement under penalty of perjury

    • “I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.”

  3. Your contact information

    • Your name, mailing address, phone number, and email address.

  4. Consent to jurisdiction

    • If you are in the United States: consent to the jurisdiction of the Federal District Court for your district.

    • If you are outside the United States: consent to the jurisdiction of the Federal District Court for the District of Nevada.

    • You must also agree to accept service of process from the party who submitted the original notice (or their agent).

  5. Your physical or electronic signature

6. What Happens After We Receive a Valid Counter-Notice

After we receive a valid counter-notice, we may forward it to the original complainant. Under the DMCA, the complainant may have the option to file a court action to keep the content disabled.

If we do not receive notice of a court action within the applicable DMCA timeframe, we may restore access to the material at our discretion, subject to:

  • repeat infringer policy;

  • safety/operational considerations;

  • additional rights claims;

  • Platform risk controls.

7. Repeat Infringer Policy

Show Streamz may, in appropriate circumstances and consistent with law:

  • terminate accounts of Users determined to be repeat infringers;

  • suspend Event Provider privileges;

  • restrict go-live rights or disable content upload/streaming capability;

  • impose additional verification or security requirements.

“Repeat infringer” determinations may consider valid DMCA notices, adjudicated claims, patterns of infringement, circumvention, piracy activity, or repeated violations of the Terms and Policies.

8. Live Events, Piracy, and Emergency Measures

Because Show Streamz supports live streaming, we may take rapid action when we detect or receive credible reports of:

  • unauthorized restreaming;

  • mass recording/ripping;

  • stream key compromise;

  • circumvention of DRM/session controls.

Actions may include:

  • disabling access to an Event;

  • rotating stream keys;

  • forcing re-authentication;

  • blocking suspicious sessions/IP ranges/devices;

  • preserving evidence and sharing with rights holders as appropriate.

9. Misrepresentations and Abuse of the DMCA Process

Submitting false, misleading, or bad-faith notices or counter-notices may lead to:

  • denial of the request;

  • account enforcement under the Terms;

  • disclosure of your notice/counter-notice to the opposing party as required by law; and/or

  • potential legal liability.

Show Streamz reserves the right to request additional proof of authority and ownership when warranted.

10. Non-Copyright Complaints (Trademark, Publicity, Privacy)

For non-copyright issues, contact legal@showstreamz.com with:

  • the URL(s) and description of the issue;

  • proof of rights/authority;

  • your contact information.

Examples include:

  • Trademark complaints (brand/logo misuse);

  • Publicity rights complaints (unauthorized use of name/likeness);

  • Privacy complaints (private info disclosed, non-consensual content).

For harassment/safety complaints, also report to support@showstreamz.com under the Community Guidelines.

12. Updates to This Policy

We may update this Policy periodically and will post the revised “Last Updated” date. Continued use of the Platform after updates constitutes acceptance of the updated Policy.
